Purchase and sale agreement
By making a purchase in the leksopt.com online store, the user agrees to all of the following terms and conditions of this agreement.
1. General provisions
1.1 This agreement is a public offer and includes all terms of purchase and sale through this online store.
1.2 If you accept the terms of this agreement and pay the full cost of the order, you become the buyer.
2. Terms and definitions
2.1 Seller – leksopt.com
2.2 Buyer - an individual or legal entity who is legally capable and has accepted this offer, in accordance with Art. 642 of the Civil Code of Ukraine;
2.3 Online store - this site;
2.4 Product is a material good that can satisfy demand, which is the subject of an agreement between the parties, from the assortment of this online store;
2.5 Registration is a voluntary agreement of the buyer to leave his data for processing and placing an order;
2.6 Prepayment is a voluntary transfer by the buyer by any non-cash method of funds to the seller’s account, as payment for the goods;
3. Subject of the agreement
3.1. The Seller undertakes to transfer ownership of the goods to the Buyer, and the Buyer undertakes to pay for and accept the goods under the terms of this agreement.
3.2. This agreement governs the purchase and sale in the online store, including:
a) voluntary selection by the Buyer of goods in the online store;
b) the Buyer’s independent placing of an order in the online store;
c) payment by the Buyer of an order placed in the online store;
d) execution and transfer of the order to the Buyer into ownership under the terms of this agreement.
3.3. This agreement governs the purchase and sale of all goods on the Seller’s website.
4. Procedure for placing an order
4.1. The buyer places an order in the online store independently by filling out a special electronic form.
4.2. The Buyer agrees to the voluntary transfer of his personal data to the Seller for their processing and storage, in accordance with the current legislation of Ukraine.
4.3. The Buyer agrees that after successful Registration on the Seller’s website, the Seller can send letters and advertising messages to the Buyer’s email address.
4.4 Transfer by the Seller of any data about the Buyer to third parties is possible only in certain cases provided for by the current legislation of Ukraine.
5. Cost and order of payment
5.1. The total cost of the order consists of the cost of the goods indicated in the online store.
5.2. The cost of order delivery depends on the current tariffs of courier services selected by the Buyer from the list offered by the Seller.
5.3. Payment for goods by the buyer is made by 100% prepayment within two working days from the date of order.
6. Order delivery
6.1. The process of delivering an order to the Buyer is conditionally divided into two stages, order processing and order delivery.
6.2. Order processing is completed within two business days. Delivery of the order, depending on the delivery method chosen by the Buyer, is carried out within the time limits provided by the specialized organization.
6.3. When transferring the Goods from a specialized organization, the Buyer independently checks the conformity, quality, quantity, appearance of the Goods and confirms that there are no claims to the conformity, quality, quantity and appearance of the Goods. If at this stage the Buyer has not voiced any claims against the Seller, then further claims by the Buyer regarding the conformity, quality, quantity and appearance of the Goods will not be accepted.
7. Procedure for returning goods
7.1. Exchange and return of goods is carried out by the Seller in accordance with the Law of Ukraine “On the Protection of Consumer Rights.”
7.2. The Buyer is obliged to confirm the fact of purchasing the Product in the online store. To do this, you must provide the Seller with a set of relevant documents.
8. Rights and obligations of the parties
8.1. The buyer is obliged:
A) place an order in the online store;
B) pay for the order according to the terms of this agreement;
B) receive the order in accordance with the terms of this agreement.
8.2. The Buyer has the right to demand that the Seller comply with the terms of this agreement.
8.3. The seller is obliged:
A) comply with the terms of this agreement;
B) transfer the goods to the Buyer in accordance with the placed order under the terms of this agreement;
B) bear full responsibility to the Buyer for completing the order before transferring the order to courier services;
9. Responsibility of the parties
9.1. In the event of force majeure or force majeure (fires, floods, natural acts, military actions, etc.), the parties are released from the execution of this agreement and any liability under this agreement.
9.2. The parties are obliged to make every effort to resolve any disagreements, if any. Disagreements between the parties are resolved exclusively through negotiations. Otherwise, the contract may be declared invalid or terminated.
9.3. The seller is not responsible; cannot act as a defendant in court; does not compensate for losses incurred by the Buyer due to the actions or inaction of third parties, including the specialized organization delivering the goods.
10. Duration of this agreement
10.1. This agreement comes into force from the date of its publication on the website leksopt.com and is valid until the Parties fulfill their obligations.
